7.1. What Is the Right of Publicity?

The right of publicity allows each individual to control and profit from the commercial value of his or her own identity. The right covers all aspects of an individual’s identity including name, likeness, voice, and personally identifying characteristics. The right of publicity evolved from the right of privacy and like the right of privacy, it is governed by state law. Many – but not all – states treat the right of publicity as distinct from the right of privacy.
