once the beginning stage of mediation facilitated by the mediator has been completed, he or she will ask the parties to make their opening statements. These presentations provide general information to all negotiators and the mediator on some, but not necessarily all, of the following topics:

  • The parties' views on their past, current, and potential future relationships, interactions, and dynamics
  • The background on and development of the dispute
  • Issues they want to discuss
  • Their needs, interests, and concerns
  • Options for or positions on desirable outcomes
