Chapter Thirteen. Problem Employees

All employers have problem employees—those, for example, that abuse alcohol and drugs, are frequently absent, or engage in criminal behavior. In the spirit of avoiding lawsuits before they occur, you may want to review your company’s policies regarding drugs and alcohol, attendance, and criminal behavior. Employers with clear, well-distributed policies—and the courage to take prompt, consistent, fair action when these policies are violated—have less chance of getting sued. In the event of a lawsuit, they have a much stronger chance of prevailing.
