Many employment-related lawsuits are born when an unemployment compensation claim is denied. At this point, if your reasons for dismissing the employee were vague or inconsistent, they could come back to haunt you.

  • Think of an unemployment hearing as a mini-trial where the burden of proof is on the employer.
  • Designate one person in your organization to communicate with the state unemployment office and to answer its questions.
  • Consider hiring an attorney to represent the company if you expect a discrimination suit by the employee.
  • Request a copy of the record of any unemployment insurance hearing. In the event of a lawsuit you may need it, even years later.
