Chapter Seven. Trusting but Verifying

Sometimes an attorney learns more from cases he loses than cases he wins. This has certainly happened to me when I trusted people I should have doubted. In the course of an investigation, there may be times when a supervisor or manager lies to you or makes unwarranted assumptions. I can recall three times when I did not know the client’s supervisors and/or managers were less than honest with me and I made the mistake of taking them at their word. In each case, it caused substantial harm to the defense. In each case, that harm could have been avoided had the defense been made aware of the true facts before deposition and especially before trial. This chapter looks at those three cases.
