Chapter Two. Good Intentions Are Only a Start

If you manage people long enough, you will eventually have to fire, demote, or discipline an employee (in the field of human resources and employment law, this is known as taking an “adverse action”). In my experience, a discrimination lawsuit tends to occur when an employee (or, more likely, his attorney) does not believe that the employer has the facts to support the adverse action it took against the employee.

It has been my experience that the great majority of employers have no desire to discriminate unlawfully against anyone. To be sure, there are personal bias issues, but these do not necessarily involve a deliberate intention to discriminate.
