Dealing with Tribunal Cases

The number of employment tribunal claims in 2012/13 was 191,541, an increase of 3 per cent on the previous year. There are many employees who feel that they have nothing to lose by pursuing a tribunal case, and even where there is little chance of success, pressure can be brought to bear on the employer to settle before the hearing. Many are prepared to do so to avoid the time and effort involved in fighting a case, even where they feel that there is no justification for the claim. In 2012/13 around 61 per cent of cases were settled or withdrawn before reaching a tribunal hearing. Of all cases 11 per cent were successful and the average (mean) awards were:
