Design and Plant Patent Applications

The process of filing and prosecuting applications for design and plant patents is similar to that for utility patents. Owing to their shorter economic life, the PTO has created an expedited procedure for design applications upon payment of a $900 fee. Design patents have only one claim, and the drawing should clearly depict the appearance of the article because the drawing defines the scope of patent protection for design patents. Their term of duration is fourteen years from the date of grant, and no maintenance fees are due during the term. Design patents are designated with the letter D, as in ''D395,122.''
