The System to Prevent Litigation: Who Should Manage It, and Why

As we see it, in-house counsel will be in the forefront of a paradigm shift for lawyers. For this reason, which we believe is not yet appreciated, in-house attorneys will be more specialized and valuable in the future.

And precisely because of their expertise and proximity to communications within the enterprise, and received by the enterprise, the system we describe in this book must be instituted and controlled by the Legal Department, headed by the General Counsel (or the Chief Legal Officer), or by a law firm serving the company in that same capacity.1
