Legal Issues

Like all media and advertising content produced within an organization, podcasting presents some important legal issues for the organization to consider and resolve. These issues can be viewed as falling into four broad categories: (1) clearing rights for images, text, and sounds appearing in the podcast (like copyright, rights of publicity, and trademark rights); (2) protecting the podcast content from being infringed (except in those instances when you want it to be ripped, remixed, and virally spread across the Internet); (3) media law issues (like avoiding defamation); and (4) general Internet business issues (like terms of service (TOS) and general contract rules over the Internet).
