Common law” refers to refers to a system of law in which traditions, customs, and precedents have the same “force of law” as existing laws or statutes that have been enacted as a result of the full legislative process. With a common law system, laws and statutes are quite literally interpreted and reinterpreted on a case-by-case basis. The way this works is that each interpretation and each case sets a precedent, but can also be reinterpreted, thus setting a new precedent. As it evolves, this process results in rights being granted to employees on an individual basis.
