Recognition of Potential Disputes

Anticipating disputes is not hard—it is almost impossible. There is no telling from where a dispute may arise and when it will appear.

Project managers have to look at the statement of work, contract documents, engineering specifications, and drawings with their bidding contractor hats on. With this approach, the project manager should then generate a pre-bid list of questions that he would ask at a pre-bid conference. This way the project manager can “head the dispute off at the pass” during the pre-bid phase.

It is beneficial to have a follow-up meeting, called an assumptions meeting, to provide to the bidders another chance to submit questions and state what assumptions are being made in preparing the estimates. ...
