Finding the right format

Some negotiations, however hard fought, are essentially informal. No elaborate record of proceedings is necessary, and both parties are content to implement whatever has been agreed. The discussion may be only brief, and, once concluded, quickly forgotten.

Other negotiations may need to state clear arrangements, without necessarily having to be in writing. It should, though, be noted that a verbal contract can be binding in a court of law (as can an email). Consider this category very carefully. Check as to whether anything formal is in fact necessary.
