The Case

Federal law prohibits some, but not all, broadcast advertising of lotteries and casinos. 18 U.S.C. § 1304. Among other things, Section 1304 and FCC regulations prohibit radio and television broadcasters from carrying advertising about privately operated commercial casino gambling. In the 1990s, broadcasters in Louisiana challenged the ban on advertising private commercial casinos on First Amendment grounds, arguing that stations should be permitted to advertise these casinos in Louisiana and Mississippi where they were legal and regulated.
