Understanding India’s Legal System
By and large, the Indian legal system has been modeled on English Law, which makes it far easier for Westerners to understand than the legal systems of other Asian countries. This applies to civil, criminal, and economic laws.
While it is true that the Indian legal system—especially the judicial system—is overworked and sometimes suffers from inordinately delayed verdicts, the fact remains that the law and standard procedures are respected. The delays have become a focus of some concern and various measures are being thought of and implemented to make the system work more efficiently. Regardless of the speed of the system, you need to understand certain features of the law in India, and this section contains that useful information.
India is a land of diverse religions and each has codes of conduct applicable to it. So adherents to each religion have a set of personal laws to conform to. As far as criminal offenses are concerned, the most important rules are those set out in the Indian Penal Code and the Code of Criminal Procedure. Infringement of Intellectual Property Rights, violation of environment and human rights norms, and non-payment of fines are all punishable offenses. Chapter 13 deals with law in more detail.
