A Note to the Chairperson and Members of the NCW

This is with reference to the decision taken at the meeting with you on March 17 to give our view of the legal position vis-a-vis the Government note dated December 17, 1997 and the earlier actions relating to consultants.

  1. Whatever the inadequacies, the NCW Act 1990 grants important powers to the Commission. It is important to assert these powers rather than ask for further powers or amendments at this stage. We want to emphasise that contrary to some perceptions, the Commission is NOT a recommendatory body in the powerless sense that other Commissions were.
